These Terms and Conditions govern your use of the Smart Money Broke Minds website at smartmoneybrokeminds.com and web application at app.smartmoneybrokeminds.com (collectively, the "Platform"), operated by Smart Money Broke Minds LLC in the State of Florida. By accessing or using our Platform, creating an account, or making any purchase, you agree to be bound by these Terms. If you do not agree, do not use our Platform.

1. EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY

All information, content, courses, webinars, community discussions, stock screening tools, coaching sessions, and resources provided by Smart Money Broke Minds are intended solely for educational and informational purposes.

Smart Money Broke Minds is NOT a registered investment advisor, broker-dealer, financial planner, or licensed financial professional with the SEC, FINRA, or any regulatory body. Nothing on this Platform constitutes financial advice, investment advice, trading advice, or a recommendation to buy or sell any security, cryptocurrency, futures contract, or other financial instrument.

Past performance discussed within our community or courses is not indicative of future results
All investments carry risk including the potential loss of your entire principal
SMBM and its instructors, coaches, partners, and community members may hold positions in securities discussed — this is a conflict of interest you should be aware of
Always conduct your own independent research and consult with a licensed financial professional before making any investment decisions
Any decisions you make based on information obtained through SMBM are solely your own responsibility

2. ELIGIBILITY & ACCOUNT REGISTRATION

You must be 18 years of age or older to create an account and use our Platform
You must provide accurate, current, and complete information when creating your account
You are responsible for maintaining the confidentiality and security of your account credentials
You may not share your account access with any other person
You are responsible for all activity that occurs under your account
You must notify us immediately at smbm@smbm.site if you suspect unauthorized access to your account
SMBM reserves the right to refuse account registration to anyone at its sole discretion

3. SUBSCRIPTIONS & PAYMENTS

Current Pricing:

Current prices for all memberships, programs, and payment plans are listed on our pricing page and shown at checkout
The price shown at checkout at the time of your purchase is the price that applies to that purchase
SMBM may change its prices at any time; price changes to recurring memberships will apply to future billing periods, and we will provide notice before a price change affects your recurring membership
All prices are in US Dollars

Smart Money Community — Membership Options:

Monthly: billed automatically on the same date each month until you cancel
Yearly (Pay in Full): billed once for 12 months of access, and renews automatically each year at the yearly rate then in effect until you cancel
Yearly (3 Payments): the yearly price split into three monthly payments for 12 months of access
Membership fees are non-refundable per our No-Refund Policy
You may cancel a monthly or yearly pay-in-full membership at any time through Settings, under My Membership, or by contacting us
Cancellation stops future billing at the end of the current billing period
Your access remains active through the end of your paid billing period
No prorated refunds or partial refunds will be issued for unused time
Members with an active Smart Money Community membership may not purchase a second membership

Yearly 3-Payment Plan — Auto-Renewal:

All three scheduled payments apply once you enroll in the 3-payment plan, and the plan cannot be canceled partway through
When your 12-month period ends, your membership automatically continues at the monthly rate then in effect, billed monthly, unless you turn off auto-renew in Settings, under My Membership, before the renewal date
If auto-renew is off, your membership ends at the close of your 12-month period and no further charges are made after your scheduled payments
You may turn auto-renew back on at any time before the renewal date
By choosing the 3-payment plan, you authorize SMBM to charge your payment method for each scheduled payment and, if auto-renew is on, for monthly charges after your 12-month period

Rich Mindset Coaching — One Time Payment or 3 Payments:

Rich Mindset Coaching is available as a one-time payment or as three monthly payments over 90 days
Full program access begins on your first payment for both the pay-in-full and 3-payment options
Coaching is delivered primarily in a group format
After the 90-day window ends, live program areas become locked; SMBM may, at its discretion, offer renewal options
Live program access expires after 90 days regardless of usage
Included community access expires after 1 year regardless of usage
Missed or unused coaching sessions are not refunded or rescheduled beyond the 90-day window
Members who already own Rich Mindset Coaching may not purchase it again through checkout; renewals are arranged by contacting SMBM
All Rich Mindset Coaching payments are non-refundable

Rich Mindset Coaching — What's Included:

A 90-day live program window, beginning on your enrollment date, covering webinars, the Rich Mindset community chat, and coaching and mentorship
A digital copy of the mindset book, available as a limited-time bonus; SMBM may discontinue the book bonus for future enrollments at any time, and enrollments made while the bonus is offered keep their digital copy
1 year of Smart Money Community access from the date of enrollment
Mindset course content for the included 1 year, and afterward for as long as you remain an active Smart Money Community member

3-Payment Plan — Missed Payments:

If a scheduled payment fails, SMBM will automatically retry the payment during a limited retry period, and you will see a notice in your account asking you to update your payment method
If your outstanding payment is collected during the retry period, your access will continue, or be reinstated if it was paused, and your plan will continue as scheduled
If the payment cannot be collected by the end of the retry period, your program access will be revoked and your remaining scheduled payments will be canceled
Payments already made are non-refundable, and access revoked after the retry period ends will not be reinstated

Founding Member & Promotional Pricing:

Promotional or founding-member pricing is available for a limited number of purchases and may end at any time without notice
Promotional pricing applies only while your membership remains continuously active; if you cancel and later rejoin, the price in effect at that time applies
Promotional codes cannot be combined and have no cash value

General Payment Terms:

All payments are processed securely by Stripe
We do not store your full payment card details
You authorize SMBM to charge your payment method on a recurring basis for recurring memberships and scheduled installment payments until you cancel or your plan ends
If a payment fails, your access may be suspended until payment is resolved

4. NO REFUND POLICY

All sales are final. No refunds, exchanges, credits, or returns will be provided for:

Smart Money Community membership fees, including monthly, yearly, and 3-payment plans
Rich Mindset Coaching program fees, including pay-in-full and 3-payment plans
Any courses, digital products, or downloadable resources
Books in digital or audio format, once purchased
Books in physical format, once shipped
Merchandise and physical products, once shipped
Event tickets, including launch events, founding classes, and workshops, whether or not you attend
Any consultations or coaching sessions, whether completed, partially completed, or missed

The only exceptions to this Policy are an event canceled by SMBM, as described below, and billing errors as described in our separate No-Refund Policy.

Event Tickets:

Event tickets are non-refundable and non-transferable unless SMBM states otherwise in writing
Event ticket purchases are not credited toward any membership, program, or other SMBM product unless the specific event listing states otherwise
If SMBM cancels an event, ticket holders may choose either a full refund of the ticket price or a ticket for the rescheduled date
Changes to an event's venue, schedule, or agenda are not a cancellation and do not qualify for a refund

Damaged or Defective Physical Items:

If a physical book or merchandise item arrives damaged or defective, contact smbm@smbm.site within 14 days of delivery with your order details and a photo of the item
SMBM will replace the item at no cost to you; this is a replacement only and does not create a right to a refund

Payment Disputes:

If you have a billing concern, contact smbm@smbm.site before filing a dispute or chargeback with your bank or card issuer
Filing a dispute or chargeback for a purchase covered by this Policy may result in immediate suspension or termination of your account and access

SMBM reserves the right to terminate any account or membership for violations of these Terms without refund.

5. SMART MONEY COMMUNITY — MEMBERSHIP FEATURES

Your Smart Money Community membership provides access to:

Community chat rooms for Wealth Building, AI Training, Cryptocurrency, and Futures Trading
Course content libraries for each community room, including resource links, streamed videos, and webinars
Stock screener and fundamentals analysis tools
Instructors Watchlist, subject to the terms in Section 10
SMBM Journal, a trading journal tool
Budget calculator
A free Mindset preview, including select Mindset videos and a read-only preview chat
Live webinars and educational events
Member progress tracking
Direct messages with SMBM staff, when enabled by SMBM per Section 6

Rich Mindset Coaching Access:

Full access to the Rich Mindset community room, live coaching, and the complete Mindset course library requires Rich Mindset Coaching enrollment, as described in Section 3
The free Mindset preview is read-only; only SMBM may post in the preview chat

Video & Course Content:

Course videos are streamed through the Platform for members with active access only
You may not download, screen-record, capture, or redistribute any video or course content
Access to course content ends when your membership or program access ends

Tools & Data:

The stock screener, Instructors Watchlist, SMBM Journal, budget calculator, and all other tools are provided for educational purposes only and are subject to Section 1
Market data shown in Platform tools comes from third-party sources, may be delayed or inaccurate, and should not be relied on for trading decisions
SMBM Journal entries are for your personal use, and SMBM will not display your individual journal entries or statistics to other members without your consent
Some tools, including the SMBM Journal, may also be offered separately to non-members on different terms

SMBM reserves the right to add, modify, or remove features from the Platform at any time without notice.

6. COMMUNITY RULES & ACCEPTABLE USE

By participating in our community chat rooms, direct messages, or any other interactive feature of the Platform, you agree to the following rules:

You MUST NOT post or send content that:

Constitutes financial advice, specific investment recommendations, or stock tips to other members
Promotes, solicits, or advertises any external business, product, service, or community
Is threatening, harassing, abusive, defamatory, obscene, or discriminatory
Violates any applicable law or regulation
Infringes the intellectual property rights of any third party
Contains false or misleading information
Involves pump-and-dump schemes, market manipulation, or any fraudulent financial activity
Shares another member's personal information without their consent
Involves spam, repetitive posting, or disruptive behavior

Moderation:

SMBM and designated partner moderators reserve the right to delete any post or message, issue warnings, or remove any member from the community at any time without refund
Repeated violations may result in permanent account termination without refund
SMBM is not responsible for the accuracy, reliability, or legality of content posted by community members
Always consult a licensed professional before acting on any information shared in community discussions

Direct Messages:

Direct messaging with SMBM staff, including admins, partners, and instructors, is enabled at SMBM's sole discretion and may be turned on or off for any member at any time
All Community Rules in this Section apply to direct messages
Direct messages are intended for educational support, course questions, and program-related communication only, and staff will not provide personalized financial, investment, or trading advice through direct messages
SMBM may retain direct message history after messaging access is removed, for moderation, compliance, and quality assurance purposes
Do not share sensitive personal or financial information in any message, including account numbers, passwords, or brokerage login details

Reporting Concerns:

If you believe you have experienced harassment, or received personalized financial advice or a specific recommendation directed to you from any partner, instructor, or moderator, whether in a chat room, direct message, coaching session, or anywhere else on the Platform, report it immediately to smbm@smbm.site
Tickers displayed in the Instructors Watchlist, and general educational discussion of those tickers, are governed by Section 10 and do not by themselves constitute a specific recommendation to you
SMBM will review reported concerns and may take action including warnings, content removal, suspension, or termination of the partner's or member's access

7. DIGITAL PLATFORM & APP TERMS

By creating an account and accessing our app at app.smartmoneybrokeminds.com you agree that:

You will use the Platform only for lawful purposes
You will not attempt to gain unauthorized access to any part of the Platform or other users' accounts
You will not reverse engineer, scrape, or copy any part of the Platform
You will not use automated tools, bots, or scripts to access the Platform
You will not upload malicious code, viruses, or harmful content
You agree to receive transactional emails related to your account, including account notices, payment confirmations, and billing reminders; these are not marketing emails and cannot be opted out of while your account is active
SMBM reserves the right to suspend or terminate accounts that violate these terms immediately and without notice

The Platform is provided on an as-is basis and SMBM does not guarantee uninterrupted access.

8. INTELLECTUAL PROPERTY & LICENSE

All content on the Platform including but not limited to courses, videos, tools, branding, logos, and written materials is the intellectual property of Smart Money Broke Minds unless otherwise stated
You are granted a limited, non-exclusive, non-transferable license to access and use Platform content for your own personal, non-commercial educational purposes only
You must not copy, reproduce, republish, sell, rent, sublicense, redistribute, or publicly display any Platform content without prior written permission from SMBM
User-generated content you post in community rooms remains your property but you grant SMBM a non-exclusive license to display and use that content on the Platform
No use of the SMBM name, logo, or brand is permitted without prior written approval

9. CONSULTATION CALL POLICY

Consultation calls are generally 15 to 30 minutes in length
Consultations are scheduled and paid through a third-party booking service, and that service's terms also apply to your booking
Calls are intended for educational and informational purposes only
Consultations do not create any professional-client relationship
No financial, investment, legal, tax, or medical advice is provided
Results are not guaranteed
All consultation calls may be recorded for legal compliance, quality assurance, and training purposes
By scheduling a consultation you consent to recording of the session
SMBM reserves the right to terminate, reschedule, or refuse any consultation call at any time for any reason without refund

10. PARTNER & INSTRUCTOR RELATIONSHIPS

Partner and instructor relationships within the Smart Money Community are governed by separate Partner & Instructor Agreements. Nothing on this Platform implies that any partner or instructor is an employee or agent of SMBM. Partners are independent contractors. SMBM is not responsible for the specific advice, recommendations, or content provided by individual partners or instructors beyond SMBM's general editorial standards.

No Apparent Authority:

Titles used by partners or instructors on the Platform, including but not limited to "Life Coach" or similar designations, do not indicate licensure, certification, or credentialing as a financial advisor, broker, or other regulated financial professional
No partner, instructor, or moderator is authorized to speak on SMBM's behalf regarding any specific financial, investment, or trading decision, and no such statement by a partner should be understood as reflecting SMBM's endorsement or advice
If any partner, instructor, or moderator provides you with a personalized financial recommendation directed to you, or if you experience harassment from a partner, instructor, or moderator, that conduct is outside the scope of what SMBM authorizes and should be reported immediately per Section 6

Instructors Watchlist:

The Instructors Watchlist displays stocks, futures, cryptocurrencies, or other instruments that SMBM instructors are currently watching, for educational and discussion purposes only
Watchlist items are not recommendations to buy, sell, or hold any instrument, are not tailored to your personal financial situation, and do not constitute financial, investment, or trading advice
Inclusion on the Watchlist does not mean an instructor has entered or will enter a position, and removal does not mean an instructor has exited one; SMBM is not obligated to notify members of Watchlist changes
SMBM, its instructors, and its partners may hold positions in instruments shown on the Watchlist and may trade them at any time without notice, which is a conflict of interest you should be aware of
Prices, charts, and market data shown with the Watchlist come from third-party sources, may be delayed or inaccurate, and should not be relied on for trading decisions
Always conduct your own independent research and consult a licensed financial professional before acting on anything shown in the Watchlist

11. RIGHT TO REFUSE SERVICE & TERMINATE ACCOUNTS

SMBM reserves the right to:

Refuse service or deny access to any person at its sole discretion
Suspend or terminate any account immediately for violations of these Terms
Remove any member from the community for any reason
Cancel any subscription or membership without prior notice for violations of these Terms

No refund will be issued in connection with account suspension or termination due to violations of these Terms.

12. DISCLAIMER OF WARRANTIES

The Platform and all content, tools, and services are provided on an as-is and as-available basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. SMBM does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. SMBM does not warrant the accuracy, completeness, or usefulness of any information on the Platform.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Smart Money Broke Minds, its owners, affiliates, employees, contractors, partners, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:

Use of or inability to use the Platform
Any financial or investment decisions made based on Platform content
Community participation or reliance on content posted by other members
The conduct of any partner, instructor, or moderator, including any advice given or interpersonal conduct occurring in connection with the Platform, to the extent such conduct exceeded the scope of that individual's authorization from SMBM
Unauthorized access to or alteration of your account
Any loss of data or profits
Any other matter relating to the Platform

Your use of the Platform is entirely at your own risk. In no event shall SMBM's total liability to you exceed the amount you paid to SMBM in the 30 days preceding the event giving rise to the claim.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Smart Money Broke Minds and its owners, officers, agents, partners, and employees from any claims, damages, losses, liabilities, and expenses including attorney's fees arising from your use of the Platform, your violation of these Terms, your violation of any third-party rights, or any content you submit to the Platform.

15. PRIVACY

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at smartmoneybrokeminds.com/privacy-policy.

16. COOKIES

The Platform uses cookies to personalize your experience and maintain your login session. By using the Platform you agree to our use of essential cookies. Please see our Privacy Policy for full details on how we use cookies.

17. LINKS TO OTHER WEBSITES

Our Platform may contain links to third-party websites. We are not responsible for the content or privacy practices of those websites. Links do not constitute endorsement of those sites or their content.

18. CHANGES TO THESE TERMS

SMBM reserves the right to modify these Terms at any time. We will notify you of material changes by updating the Last Updated date at the top of this page and where appropriate by email notification. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.

19. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the State of Florida without regard to its conflict of law provisions. Any disputes, claims, or controversies arising out of or relating to these Terms, your use of the Platform, products, services, consultations, or community membership shall first be attempted to be resolved through good faith negotiation between the parties. If negotiation fails, disputes shall be resolved through binding arbitration in the State of Florida in accordance with the rules of the American Arbitration Association before either party may pursue any court action.

Any arbitration or proceeding shall be conducted on an individual basis only, and not as part of a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against SMBM. You waive any right to a jury trial in connection with any dispute arising from your use of SMBM products or services.

Notwithstanding the foregoing, SMBM reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

20. ENTIRE AGREEMENT

These Terms together with our Privacy Policy and No-Refund Policy constitute the entire agreement between you and Smart Money Broke Minds regarding your use of the Platform and supersede all prior agreements, representations, and understandings. Partner and instructor relationships are governed by separate Partner & Instructor Agreements.
